Synopsis: |
The Government has called time on self-regulation of pub companies and has now consulted on a Statutory Code of Practice, to be overseen by an Adjudicator. The Committee recommended this action in 2011 and therefore welcome the Government's proposals. They agree with the Government's intention to include the overarching principles of fair dealing and that a tied tenant should be no worse off than a free-of-tie-tenant. However, further clarity is necessary on how these principles will be achieved through legislation. The Code should also include a mandatory free-of-tie option. If the tied model proves it delivers significant benefits, then it will continue to be an attractive model for new and existing lessees. The Committee accepts the rationale for setting a threshold of 500 pubs but recommend that flexibility be included in any Bill. We also recommend that it only applies to pub companies with leased and tenanted pubs. PICAS and PIRRS have been positive developments in the pub industry, and the Government should ensure that these services are retained in the new statutory framework.The Adjudicator, overseeing the Statutory Code, should be given the full suite of powers, including the power to fine. The Government has belatedly come to the right decision. However, implementation of this legislation may still be at risk from the Parliamentary timetable. There can be no more delays in resolving this matter and the Government should bring forward a Bill at the earliest opportunity |
