This is a joint consultation paper from the Law Commission (LCCP, 188) and the Scottish Law Commission (Discussion paper no. 139) on the subject of consumer remedies for faulty goods. The terms of reference for this consultation were as follows: (i) to examine the existing consumer remedies under the Sale of Goods Act 1979 (PGA 1979 Ch. 54, ISBN 9780105454793), the Supply of Goods (Implied Terms) Act 1973 (PGA 1973 Ch. 13, ISBN 9780105413738) and the Supply of Goods and Services Act 1982 (PGA 1982 Ch. 29, ISBN 9780105429821), for goods which do not conform to contract; to make appropriate recommendations within the current framework of EU law; to advise the Department for Business, Enterprise and Regulatory Reform on issues raised in the course of the EU review. The aim of the consultation is to simplify the remedies available to consumers, bring the law into line with accepted good practice, and provide appropriate remedies which allow consumers to participate with confidence in the market place. |
