In the planning world, the concept of prematurity involves planning permission being refused because granting it would prejudice the development plan process. Eighteen months ago, prematurity rarely troubled the Planning Appeals Commission, or the development community. The Commission had been called upon to decide only a handful of cases. What changed all this was the DOE's response to the Regional Development Strategy. That response proposes through emerging area plans to draw in development limits, and to exclude land currently available for housing. Today, RDS-related prematurity is undoubtedly the key issue before the Commission, and the central battlefield for the DOE and developers. About thirty appeals have been decided, and there are many more to come. The subject matter is extremely difficult and convoluted, but must be understood by all those affected, and their advisers.
